Legal Statement
Important Notice: The user is solely responsible for ensuring their use of this software complies with all applicable laws. The legal assessments provided below are strictly based on German jurisdiction and may not apply in other countries.
1. Copyright & Private Copying
Under German copyright law (§ 53(1) UrhG), downloading publicly accessible videos for private use is permissible provided the source is not obviously illegal and no technical protection measures (DRM) are circumvented (§ 95a UrhG). This software functions as a neutral tool that exclusively processes unencrypted data streams.
2. Database Rights
Automated retrieval of content from an individual profile does not constitute the extraction of a "substantial part" of a platform's database under § 87b(1) UrhG, and therefore does not infringe upon database producer rights.
3. Criminal Law
The software only accesses publicly available data or data for which the user has a legitimate access right (e.g., via session cookies). As it does not bypass access controls, it does not violate § 202a StGB (data espionage).
4. Competition Law & Terms of Service
In accordance with the German Federal Court of Justice (BGH I ZR 154/16), providing client-side automation software does not constitute unfair competition (§ 4(4) UWG). Additionally, unacknowledged "browsewrap" Terms of Service are generally not legally binding for non-registered users in Germany (§ 305(2) BGB).
5. Trademark Law
The descriptive use of platform names is strictly necessary to indicate technical compatibility, which is permissible under § 23(1)(2) MarkenG. This does not imply any official association, sponsorship, or endorsement.
6. Youth Media Protection (JMStV)
The software complies with the German Youth Media Protection State Treaty (JMStV) as it functions purely as a local application tool (§ 3 No. 9 JMStV) that processes user-supplied URLs. It does not host, distribute, or autonomously convey adult content, and thus does not qualify as a "provider" obligated to implement closed user groups (§§ 3, 4 JMStV). The legal obligation for age verification and access restriction remains exclusively with the operators of the respective third-party platforms (§ 5(1) JMStV).
